Global Telephony & Regulatory Compliance
Comprehensive compliance framework for automated conversational voice calling operations across the United States, European Union / United Kingdom, and the Middle East (UAE).
1. Introduction & Commitment to Compliance
AI Chief operates autonomous outbound and inbound telecommunications systems on behalf of enterprise real estate clients. We enforce a fail-closed regulatory framework ensuring that all automated voice outreach strictly complies with telecommunications laws, consumer protection statutes, consumer privacy frameworks, and emerging artificial intelligence transparency mandates.
Our infrastructure maintains automated geo-fencing, call frequency restrictions, calling window enforcement, and programmatic opt-out handling before any outbound dial is initiated.
2. US Regulations: TCPA, FCC, TSR & STIR/SHAKEN
In the United States, all automated calls are governed by the Federal Communications Commission (FCC), the Federal Trade Commission (FTC), and the Telephone Consumer Protection Act (47 U.S.C. § 227):
- Permissible Calling Timeframes: Outbound calls are programmatically restricted to the recipient's local timezone between 8:00 AM and 8:00 PM (exceeding federal 8 AM–9 PM rules for conservative safety).
- Prior Express Written Consent: Outbound outreach is triggered strictly in response to verifiable inbound inquiries where the consumer has explicitly submitted their contact information and authorized contact.
- Automated Do-Not-Call (DNC) Processing: Verbal opt-outs (e.g. "Do not call me again", "Remove my number") or text/SMS STOP requests are parsed in real time and automatically synchronize to your CRM and internal blacklist within milliseconds.
- STIR/SHAKEN Carrier Attestation: All carrier SIP trunks provide Level A cryptographic caller ID attestation, guaranteeing that caller IDs correspond to verified enterprise identities and mitigating carrier spam tagging.
- State-Level Mini-TCPA Protections: Automatic call frequency limits comply with restrictive state statutes (e.g., Florida FTSA, Oklahoma, Washington), restricting outbound attempts to a maximum of 3 calls per 24-hour window.
3. Europe & UK: GDPR, EU AI Act (Art. 50) & PECR
European telecommunications and consumer data are subject to stringent European Union and United Kingdom regulations:
- EU AI Act Article 50 (Mandatory AI Transparency): AI Chief system prompts enforce immediate, natural disclosure at the inception of the call that the prospect is speaking with an artificial intelligence assistant acting on behalf of the represented brokerage.
- General Data Protection Regulation (GDPR / UK GDPR): All call audio, transcripts, and metadata are processed under strict Article 6 legal grounds (Contractual Necessity or Legitimate Interest via consumer inquiry).
- Right to be Forgotten (Article 17): Enterprise clients can trigger immediate programmatic deletion of all audio recordings, text logs, and PII across all databases and vector stores via webhooks.
- UK PECR & Ofcom Silent Call Regulations: Because AI Chief uses sub-second full-duplex conversational audio models, silent or abandoned calls are virtually eliminated, operating well below the Ofcom 3% maximum threshold.
4. UAE & Middle East: TDRA Resolutions No. 56 & 57 (2024)
Telemarketing and cold/warm calling in the United Arab Emirates are regulated by the Telecommunications and Digital Government Regulatory Authority (TDRA) under UAE Cabinet Resolutions No. 56 and 57 of 2024:
- Strict Calling Hours: Outbound telephone calls to UAE numbers (+971) are permitted strictly between 9:00 AM and 6:00 PM Gulf Standard Time (GST). AI Chief hard-blocks any calls outside of this legal window.
- Call Frequency Caps: If a prospect does not answer or declines the service, AI Chief will not call more than once per day and no more than twice per week.
- National Do Not Call Register (DNCR): All numbers are verified against the UAE National DNCR registry before outbound engagement.
- Registered Caller Identification: Calls originate exclusively from registered, licensed UAE telecommunications numbers, prohibiting disguised, international spoofed, or private caller IDs.
5. Two-Party Recording Consent & PII Redaction
Audio recording laws vary between one-party and two-party (all-party) consent jurisdictions:
- Automatic Consent Disclosures: In two-party consent jurisdictions (e.g., California, Florida, Massachusetts, Germany, UK), AI Chief automatically announces: "This call may be recorded for quality, training, and appointment confirmation."
- Automated PII Redaction: Real-time neural filters automatically redact credit card numbers, bank details, and government identification numbers prior to writing transcripts into client CRMs.
- Data Encryption: All voice packets in transit use TLS 1.3 encryption, and all call metadata at rest is secured via AES-256 encryption.
6. Cookie Policy & User Consent Management
In accordance with the EU ePrivacy Directive (Directive 2002/58/EC), GDPR, UK Privacy and Electronic Communications Regulations (PECR), and US state privacy regulations (CPRA/VCDPA):
- Strictly Necessary Cookies: Deployed automatically for essential site security, CSRF protection, and load balancing. These cannot be deactivated and store no personally identifiable information.
- Equal Prominence & No Dark Patterns: Our cookie banner provides equal prominence and ease of action between "Accept All Cookies" and "Decline Non-Essential", preventing deceptive design nudges.
- Granular Choice: Performance and marketing tracking categories default to opt-out (unchecked) until affirmative consent is given.
- Instant Revocation: You can modify or withdraw your cookie consent at any time by clicking the Cookie Preferences link in our website footer.
7. Compliance & DPO Inquiries
If your legal, compliance, or information security team requires specific Data Processing Agreements (DPAs), custom time-fencing configurations, or TCPA/TDRA compliance audits for your deployment, please schedule an executive architecture walkthrough.
